Artificial Intelligence and judicial decisions
an approach from the Economic Analysis Perspective of Law
Abstract
The present study has as scope the analysis of the legal possibility of using artificial intelligence systems as support, or even substitute, in the activity of rendering judicial decisions with a decision-making nature. By using the deductive method and taking as a reference system the Economic Analysis of Law, we start from a reference to the main defining aspects of the adopted reference system. It is about the legal system as a set of rules that define a framework within which, through the jurisdictional activity, the specific and concrete standard for the settlement of disputes is constructed. It mentions the main characteristics of intelligent systems and their current uses. It analyzes, in the end, the already in place institutional available uses for artificial intelligence mechanisms within the scope of the Brazilian Judiciary System, and speculates on possible future perspectives, including the use of intelligent systems in the rendering of judicial decisions with a decision-making nature.Downloads
